Judge McCarthy earned her undergraduate degree at Indiana University and her law degree at the University of Colorado Law School. She was a Deputy District Attorney in Denver in 2008 and 2009. She was an Assistant Attorney General from 2011 to 2016 and a Senior Assistant Attorney General from 2016 to 2019.

She has been on the bench since 2019, when she was appointed a Magistrate Judge in Denver Juvenile Court. She was appointed a Judge in January 2024 and became the Presiding Judge for the Denver Juvenile Court in March 2024.
